Terms of Service

1. Acceptance of Terms

By accessing or using JewelCAD.net ("the Service"), you confirm that you are at least 18 years of age and agree to be legally bound by these Terms and Conditions. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. User Accounts

When you create an account you must provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

You agree to notify us immediately at legal@jewelcad.net of any unauthorised access to your account. We are not liable for any loss resulting from unauthorised use of your credentials.

3. Intellectual Property

The JewelCAD platform, its design, and all original content created by us are protected by copyright and other intellectual property laws.

CAD models you upload remain your property. By uploading content you grant JewelCAD.net a worldwide, non-exclusive, royalty-free licence to display, distribute, and reproduce your content solely for the purposes of operating the marketplace. This licence ends when you remove your content from the platform.

You warrant that you own or have the necessary rights to any content you upload, and that it does not infringe any third-party rights.

4. Prohibited Uses

You may not use the Service to:

Upload content that infringes intellectual property rights or contains malware
Misrepresent the quality, compatibility, or specifications of your models
Reverse-engineer, resell, or redistribute purchased models without a commercial licence
Attempt to circumvent payment or access controls
Impersonate another person or organisation
Engage in any activity that disrupts or damages the platform or other users

Violations may result in immediate account suspension and forfeiture of pending payouts.

5. Payments & Refunds

All purchases are processed via Stripe using industry-standard encryption. Prices are shown in USD.

All digital sales are final. Because CAD files are delivered instantly on purchase, refunds are generally not available unless the file is materially defective or significantly misrepresented. Refund requests must be submitted within 7 days of purchase.

We reserve the right to refuse or cancel orders at our discretion, including for suspected fraud.

6. Designer Terms

By selling on JewelCAD you agree to the following:

JewelCAD retains a platform fee of 15% on each completed sale.
Payouts are processed twice monthly (1st and 15th) for balances above $25.
Designer payouts are released 15 days after an order is marked complete to allow for dispute resolution.
You are responsible for any applicable taxes on your earnings. JewelCAD does not withhold tax.
Models must meet our quality standards and accurately represent their previews. We reserve the right to remove non-compliant listings.

7. Limitation of Liability

JewelCAD.net is provided "as is" without warranties of any kind. We do not warrant that the Service will be error-free or uninterrupted.

To the fullest extent permitted by law, JewelCAD.net shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, revenue, or business opportunity.

Our total liability for any claim arising from these Terms shall not exceed the amounts paid by you to JewelCAD in the 12 months preceding the claim.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes via email or an in-app notification.

Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, please stop using the Service and contact us to close your account.
